Agreeing to these terms

By downloading or using AudioNest, you agree to these terms. If you don’t agree, please don’t use the app.

Apple’s standard license agreement for App Store apps also applies.

Who can use AudioNest

You can use AudioNest if you’re old enough to agree to these terms where you live. If you’re not, a parent or guardian needs to agree for you.

You’re responsible for how AudioNest is used on your devices, including any cloud service you connect and the key or password you use for it.

For your own listening

AudioNest is for personal, non-commercial use. Please don’t run it as a service for other people, sell access to it, or use it to pass audiobooks on to others, unless we’ve agreed to that in writing.

Only audiobooks you have the right to use

Use AudioNest within the law, and only with audiobooks you own, have a license for, or that are free to use, like public-domain recordings. Follow copyright law and the terms of every service you connect.

Don’t use AudioNest to copy, download, keep or share audiobooks you don’t have the right to.

We don’t support piracy

AudioNest doesn’t sell, host, find or share audiobooks. We don’t support piracy or copyright infringement in any form.

Being able to import, connect, download or play something in AudioNest doesn’t mean you’re allowed to use it. Having the rights you need is up to you.

What you bring is your responsibility

You choose the files you import, the cloud services you connect and the book details you add or change. You’re responsible for having the right to use them, and for keeping your keys and passwords safe.

You’re also responsible for what follows from those choices, including any legal, privacy or security problems that come with a file or service.

Services we don’t run

AudioNest works with services run by other companies: the cloud services you connect, Apple’s iCloud, and public book catalogs that supply covers and descriptions. We don’t control them. They can change, limit what you can do, go offline or close, and they have their own terms.

We can’t promise any of them will keep working with AudioNest.

Book details can be wrong

Covers, descriptions, series, narrators and chapter names come from public catalogs, from your files, and from tidying done on your iPhone. They can be incomplete or wrong. We don’t check outside information for accuracy, and you can edit any of it.

Premium and purchases

Some features are part of AudioNest Premium. When Premium is offered for sale, you’ll buy it through the App Store, and Apple handles payment, renewals, cancellations and refunds. Subscriptions renew until you cancel them in your Apple Account settings.

We may change what Premium includes or what it costs. A price change never applies to a period you’ve already paid for.

Your library and backups

Your library, progress and listening history are stored on your iPhone, and backups go to your own iCloud Drive. We can’t see them, so we can’t recover them for you. Keep iCloud Backup on, or save a copy to Files, if your library matters to you. The Privacy Policy explains the details.

AudioNest belongs to us

The app, its name, the bird, its design and its words belong to us and are protected by law. These terms give you a personal right to use AudioNest that you can’t transfer to anyone else. We keep all other rights.

What not to do

Don’t copy, share, sell or rent out the app, and don’t reverse engineer, decompile or take it apart, except where the law allows.

Don’t use AudioNest to overload or attack any service, to get around security or limits, to collect data you’re not entitled to, or to copy its design into another product.

Changes and misuse

We may add, change or remove features at any time, including ones that depend on outside services. If something we run is misused, such as sending spam through Contact Us, we may block that use.

No guarantees

As far as the law allows, AudioNest is provided as it is and as available, without warranties of any kind. We can’t promise it will be free of errors, always available, or work with every file and service.

As far as the law allows, we aren’t responsible for lost data, problems caused by outside services or imported files, wrong book details, or how AudioNest is used. Nothing in these terms takes away rights you have under consumer law that can’t be given up.

Updates to these terms

We may update these terms. The date at the top shows the latest version, and big changes will be mentioned in What’s New in the app. If you keep using AudioNest after an update, you accept the new terms. If you don’t accept them, please stop using the app.
